If she does not, you (I'm sure you already know this) must serve her with a "30-Day Notice to Terminate Month-To-Month Tenancy", stating that you will not renew her month-to-month tenancy. It must be served upon her on or before the last day of the month to be effective the last day of the following month (ie serve her on of before Oct 31 to be effective Nov 30. You must state in this notice that if she does not vacate the apartment by Nov 30 that you will commence summary proceedings against her. Be pro-active and cover your bases; Even if you think it's ridiculous, go to the police precinct and file a complaint of harassment against her-tell the officer that she is threatening you-get a complaint number. Then serve her with the papers. The reason I suggest that you do this is that she very well might do the same after she gets the papers from you-this way you'll be on record. Don't threaten to lock her out or anything like that-be as nice as can be. If she makes verbal threats to you, get a small tape recorder with a small microphone that you can clip on your bra an tape her. Bottom line is if you want her out and she won't leave, you have to formulate your game plan, abide by the law and then stick to the plan. Having lots of your friends over all the time also helps-will make her feel totally uncomfortable and make her feel totally unfcomfortable.
