I live in NYC and recently moved out of my old apt. My landlord gave me a check refunding a portion of the security deposit, and I want to dispute the amount of the check. I just deposited this check at the bank.

2 questions:

1. By having deposited the check that he sent, do I give up any recourse to the remaining amount that I would like to dispute?

2. According to the letter, the deposit bore interest of about 2% for all of the last 5 years, which I know seems unreasonable given the market over that period (in any event it wasnt 2% each year, as the letter would indicate) Is this illegal? I know he is supposed to refund the interest every year- he never did that, but I am more concerned about the interest rate than the fact that he is a lazy ass.

Also, any advice on SCC/negotiation strategies?
