Rent Increase Room Allocation

My landord occupies 3 apartments on the bottom floor of a 5 story building. Each floor has the identical layout of 3 apartments per floor so there are 12 tennant apartments plus the equivalent of 3 apartments on the bottom floor that the landord occupies.

Recently the landord applied for a Major Capital Improvement and spread the increase over the 12 tennant apartments and he did NOT include his 3 apartments. The increase was pushed through the DHCR. Is this legal? Should he have spread the increase over 15 apartments to include his own floor as well as that of all of the tennat's?

If so, how do I go about correcting this?
