LL has a duty to mitigate his damages-meaning LL has to make good faith efforts to re-rent the apt. What has the LL done to re-rent the apt? Has he advertised it? Has he listed it with a broker? What if anything has he done? Be aware that the rental market slower and prices are down(for most properties)since 9/11: In court LL musrt demonstrate that he has made the effort to re-rent. Maybe send him a months rent and mark the check paid in full (if you can afford to)and see what happens.
