The gray area the NYS licensing division states is the fact that they don't really care... Yeah, they will say that most people wont report it, because the managing agent is doing you a favor, but where does it end? Supers, building managers, real estates and tenants charge a finders fee for an apartment. It's not fair, but nobody is really stopping it and whoever is bitten to pay up this fee, just remember to charge a fee when you fix up someone with an apartment.

I've called the NYS licensing division that handles real estate broker licensing, and the guy I talked to said it's a "can of worms" but probably legal. The state attorney general's office said they can't answer legal questions about what exactly constitutes key money.
