Your rights as a tenant in an illegal apartment are the same as in a legal one: to live in a place that is fit for human habitation, heat, hot water, no rodent infestation, garbage removal and to pay rent and not trash the place. If it is an illegal apt and you bring that to the attention of (A) the landlord or (B) the buildings dept or (C) the fire dept, then most likely you will have to move. If it is illegal, get the heck outta there.
