You will have to prove not only that substandard conditions existed BEFORE you move in, but that the broker knew about them and witheld that information from you. But that doesn't mean you can't try: You must first get the list of building violations from HPD and/or the department of buildings, then sue the broker in small claims court for the fee. You may not have a case but the broker might, might pay you something to settle the case.
