landlord smoking

I rent the 2nd floor of a 2-family house. The landlords live on the 1st floor. I often feel a strong smell of tobacco smoke in one of the bedrooms -- apparently coming from downstairs. Both my wife and I hate it. Before approaching the landlords, I would like to find out if there is any law requiring the landlord to provide clean air in the tenant's apartment. Maybe there is something in the law regulating the quality of the walls (because the smell obviously comes through them)? Any advice will be appreciated.
