I don't think they can evict, but LL can certainly bug you. Do you have anything in writing with her, like a roommate/apartment share agreement? If not, draft one now and date it from the day you moved in. The rent specified in this roommate share agreement should be for half the total rent, meaning you pay half the rent.
How is the rent paid? Do you pay her and she pays the LL? Once she returns, whatever the LL thinks is/was going on is no longer the case. Besides, 4 months does not neccesarily a sublet make, and it certianly does not rise to a non-primary residence issue as far as she is concerned. It might be a good idea for her to be able to document that this 4 month absence was work related,like pay stubs, or a letter from her boss. That is all I can think of right now.
