Boy that's a tough one. I've never been in such a situation, nor know anyone who has. But my first instinct would be to 1) ask the LL for a copy of this supposed summons. If you guys have to pay it, you have a right to see the "bill". 2) I'd call the local fire department and, without giving your name or address, say you want to ask some general questions about your situation. I'd imagine that the fire dept. could care less if people are living in a building zoned for commerce only, so long as the building is "safe" to live in. Ask them if they have any advice, as I'm sure they're very familiar with situations such as yours.
