Illegal broker's fee - only for stabilized

I am renting an apartment in a private house in Brooklyn. I discovered that my landlord was also a broker at the realty where I paid the fee. I took him to small claims court and thought there was a law that said I deserved my fee back. I lost the case because the apartment is not rent stabilized. So heads up to everyone out there - you are only protected from "illegal" broker's fees if you are rent stabilized. TenantNet, if this decision was incorrect and there is a law to protect non-stabilized tenants, please let me know. Thanks.
