To the letter of the newly adopted rent reg, the fact that you have less space and cannot stand up in what space you do have is irrelevant. The fact is, you are paying $100pm more than you should. So, remedy the situation: from now on you will pay your roommate $100 less. The fact that you agreed to the smaller space in the first place is another issue-why did you do that? The tenant is entitled, at this point, to charge 50% So, as you now know firsthand, this proportionate share thing is not all black and white. Until this gets sorted out in the courts and issues such as division of space, furnishings, come to bear on the defination "proportionate share", the tenant is entitled to charge you 50% and make you live in the "crawlspace", which by the way might not be a legal room.
Just so you know, as per the rent reg, you are entitled to have your husband & children move in with you and the tenant still can only charge you 50%.
