Air Conditioners

I have a question, well two. One what is the city law in New York regarding a
5 dollar charge for all airconditioners in an apartment? Two, I had an aircondioner
that was precariously installed (the saddle did not reach all the way to one
side of the window. The super had told us upon moving in that this was so
but that we shouldn't worry. He said that we shouldn't open the window, or
if we were going to move the airconditioner to have two people hold it since
it was heavy. When trying to clean the windows the airconditioner fell out
luckily not killing anyone. For months the building charged us the state/city
tax on that airconditioner despite we no longer had it. When requesting a new
air conditioner the management company is trying to say that we were
warned and were negligent, and therefore should pay for a new one.

I can't fathom this to be true when the airconditioner was not properly
installed to the knowledge of the building prior to it falling out.
