Tenant's Bill of Rights

I've been speaking to Milpitas CA city council, and just finished
speaking with the mayor. I gave him what I'm calling the tenants
bill of rights and asked the city to adopt it. He asked if I knew
of any other citys that have adopted anything similar. Does anyone
know?


Tenant's Bill of Rights
May 11, 1996

1. Landlords, property management companies and on-site managers constitute a professional
group that is regulated by law. Persons engaging in this business are assumed to be knowledgeable
regarding these areas of the law. Therefore all such persons will be licensed by the city at a nomi-
nal fee. A first violation will receive a written warning, a second violation is a fine of $500.00, the
third violation revokes the license of the offender. This means that if an on-site manager or prop-
erty manager is carrying out an unlawful policy, even if the policy is ordered by the landlord, then
the property manager and/or on-site manager are also liable under the law. It is unlawful to work
as a landlord, property manager or on-site manager without a current license.

2. A listing of tenant's rights under the law is to be posted in a conspicuous place on the grounds
of the apartments. A copy is to be provided to all new/existing tenants. (Failure to provide this
constitutes a violation of 1. above.)

Warranty of implied habitability

Repair and deduct remedies

Rent withholding

Tenant's Unions

Rent strikes

Related government agencies

Protection from landlord retaliation

3. Rent Control based on Santa Monica's, modified to except units constructed after 1996. The
rent formula is established at 1995 levels.
