Has anyone besides Agard v. Cajigas (NY) successfully defended eviction of Section 8 tenant due to non-renewal on 90 day non-renewal notice, but without 30 day notice for cause eviction? We haven't made the argument yet in SD County Municipal Courts but am about to. Points & authorities on any new cases since the 1996 regs implementing the change permitting non-renewal without cause for eviction? Agard is the only one I've found so far & am not certain of its citability for my trial brief. Have most of the pre-regs constil'l and due process subsidized cases at Legal Aid, where I am a tenant atty, but not on-line at work, so doing this at home. Help!
