AAAAAAAACCCCCCCCKKKKKK!

Hi!
I feel sooo frustrated! We are in an apartment in which the floor above us
cracks all night due to the guy upstairs who stays up til 5 am, pounding on the floor,
squeaking, dropping books...the floor is so thin we can hear his modem dial out,
his sneezes, his coughs..you get the point...I can't sleep! It's awful!
They advertised "new triple paned windows, great for insulation"-they are
more like 20 years old, and sooo much heat gets out, the blinds sway from
the draft! The cupboards are cracking, when we open the drawers in the kitchen,
sawdust falls onto our clean dishes in the cabinets below....there is a giant gap
under the main door-when they waterblasted outside (we're in the basement)
muddy water sprayed under the door, all over our carpet....

It's one thing after another. No lawyer will help us..I am losing my sanity,
and I am so angry! They also told us, upon looking at the apartment, that
electricity in the winter could sometimes get as high as $90-100, but it is twice
that (electric everything)! And of course, she said that, she didn't write it,
so who will believe us?

Whenever I call the office to talk to the property manager, she accuses me of "making
things up," and so on...we had a city inspector in here, but he was such a jerk,
and he brough along the local maintenance men (creeps!) without my knowing ...which
made me tense...and he (inspector) said the cracking walls and so on and SO ON..were
do to HOUSEKEEPING....??? Which makes absolutelyno sense to me!
I don't know what to do! Just because we sign a lease, doesn't mean we should
give up all rights to sanity! I can't sleep, I can't work, because I can't get
to sleep until the bozo above us sleeps...

IS there ANYTHING I can do?
I would LOVE to sue these jerks for emotional turmoil, but like that would
ever happen...I was reading the court cases posted in here, dealing with
noise issues, and I noticed almost all were turned down!

Sorry this is soo long...
I'd appreciate any advice!
