Smoke Gets in My Eyes, Ears, Nose & Throat!

As the subject line states I get to smoke but I'm a non-smoker.
I work in a smoke free environment yet my apartment seems to reek
with the smoke from the apartment below. I believe I'm covered
under the Implied Warranty of Habibility because these apartment
buildings are old and need various other repairs.

My reason for writing is because I've faced this problem before and
management said there is nothing they can do and asked me to move but
really if I move somewhere else the possibility of this happening
again exists so what have I done? I've written to management about
this problem, I've had a columnist over my apartment and a column
written on this issue and I'm currently talking it over with the
local Consumer Protection Agency and have been assigned an investigator
to this particular case...

Anyway I just e-mailed the Oprah show, this is a real issue and who
knows she's been trying to upgrade her shows quality...

My question again is doesn't the Implied Warranty of Habibility
cover me too...
