: I live in a rent stablized building with 10 apts. The main entrance is off
: the main street and through a small arch way and therefore is quite hidden to
: the general public. As a result, it's a popular for teens to hangout and
: smoke drugs. They gather in the porch area where the mail boxes are located
: and if they can they enter into the actual building and sit
: in the hallways and on the stairs. The Many tenants have ordered them out and
: called the police but the kids keep coming back !! The building Manager
: has told me he can do nothing about this problem as he "he doesn't
: live there" and to just keep calling the police. He refuses to install a
: lock on the outer door as the mailman needs access. Its really scary to
: come home at night and have to pass through 5 or 6 drugged out kids to get
: into my building. They also put graffiti on the walls and mailboxes-which
: isn't cleaned off. Doesn't the landlord have a responsibility to do
: something about this situation?? Should I write to him directly and not
: deal with the slimy Bldg Manager?? A lot of apts in the bldg have been
: burgled too. Please help.
: We had a similar problem in my building, only not as serious as yours sounds. There have been court decisions holding the landlord liable for not providing conditions where tenants can enjoy the use of their apartments in safety. You might want to research these decisions and send them to your landlord with a letter stating there is precedent and you (the tenants as a whole) intend to hold him liable for anything that should happen to you or your property as a result of his failure to keep the front entrance locked and install an intercom if necessary. The issue about the mailman is completely bogus, by the way. Many buildings have their mailboxes in the lobby beyond a set of locked doors and there is a standard Post Office approved box that the landlord installs for which the mailperson has the key. Inside is a key to the building. This is standard operating procedure. By the way, in addition to locking the building's first entrance and installing an intercom, he is probably also required by law
