How did it lose its status? Tax abatement expiration, high income?
It depends. DHCR is notorious for not notifying tenants and deregulating
on default. I think you would need to discover the facts on how it happened
to see if you have cause to re-open the case. These situations are
complicated and the law changes on these things as new court cases
come down and different fact patterns are interpreted differently.
I would see a tenant lawyer ASAP -- one who knows DHCR and deregulation
issues.
