No MDL Registration a "suicide" defense?

On a non-payment petition my landlord alleges that "the premises is
not a multiple dwelling. The Landlord resides there and rents two
apartments". The landlord lives in an apartment on the first floor,
and their are two additional apartments.

I am told that if I successfully assert that the premises IS a
multiple dwelling, I will then be evicted because the building
will then be illegal, and the court will order me out in 30 days.

Any thoughts?
