3 roommates, 5 years in house, never once late on rent; $1100 security dep
Roommates got jobs out of state, left July 1. Rent paid in full to July 15.
I made verbal deal made with landlord to exchange painting/yardwork
for 2 weeks rent, and then to pay last month in full.
As of Aug 12, rent due, painting not finished, a window was broken.
Fri Aug 15 landlord came over to see about painting, saw above, changed locks.
i wanted to wait to talk to legal or housing authority before talking to LL,
came to the house sunday 17 aug and found that all my possessions
were put in the garage. and the garage lock changed.
on Mon, 18 Aug, meeting with housing council mediator. AT the house.
LL says, "i want you out" I say, "I'm willing to pay you rent and
finish work." Housing mediator says, "ok, let's sleep on it a few days."
Easy for him to say. He had a home.
i spent a night in my car, a night on the couch at school, cant remember
a lot but ended up in the hospital Aug 26. Sept 9, out of hospital
to find false eviction petition.
"Tenant has been in house without permission since July"...
went to court. Judge threw out eviction petition after seeing note from LL
dated Aug 12, "Hows the painting coming and when can i have the rent?"
got keys to house SEPT 12.
Meanwhile, LL removed paint from house so i couldn't finish job if i'd wanted to.
LL also is requesting that i pay rent from July 15. Including the month when i
did not have keys to house. how legal is this?
and what kind of damages might i be entitled to as an unlawfully forced to move tenant?
and how do i do this?
i just found this page today. emd
