30 day notice given and landlord wants another

Posted by Dianne on October 29, 1997 at 02:10:37:

My husband and I gave our 30 day notice Oct. 1st, as we will be moving
into a brand new home. Well, on or around the 10th of October our
mortgage loan officer called and said that we might not be able to move in
until November 15th. So, my husband had asked our manager if we needed the extension, would it be possible..we did not give difinite say that
we needed it, yet they are saying we did; and everything was verbal nothing done on paper. The answer to would it be possible came today
on our door Oct. 28th stating that we have to give a full months rent for
November and if they get a tenant on or before December 1 they would
give us partial rent back for November. I don't think that's right as we never
gave final hearsay, basically our word against theirs and apparently she had
ripped up our original 30 day notice(which we have a copy of) and expects
us to give her another plus full rent when we are out of there Nov. 1. Is
she able to do that or is it illegal like it smells? Would like to know before
Thursday... Thanks
