: 1) Does the new four year rule have any bearing on my pending DHCR case? If I was overcharged, how many years is the landlord responsible for? I think it doesn't matter here as a Fair Market Appeal is not an overcharge. Don't let DHCR convert it into an overcharge proceeding.

: 2) Shouldn't the DHCR immediately have frozen my rent to what it originally should have been until this situation is resolved? Once the proceeding is over and a decision is rendered.

: 3) Can the landlord be responsible for treble damages? Not on a Fair Market appeal, but the rent should be reduced to the original rent. Do some research on this, and look for the "Smitten" case -- on the web site somewhere.
