Movein Inspection report lost by Landlord

I am moving out of an apt. in Westchester country, NYS ( NO rent control )
and the landlord has lost the movein inspection report. Further he did not
give me a copy at that time. ( Yes, I should have asked for a copy )

Now, he says I have to pay for the carpet stains that were there even when
I moved in because he wants to give the benefit of doubt to himself.

What are my options. He says I have to pay $1200 for replacing the entire
carpet though there are only couple of stains.
