: I recently moved to the second floor of an appartment building. The tenet below is a heavy smoker and the smoke rises into my appartment. I am not a smoker and find this very distressing. I asked the landlord if we could move to a different appartment. He said that we could not. Is this right? do we have any legal rights here?

David, thank you for your answer. The smoke comes mostly throught the stairwell and windows. Some smoke enters the apartment from under the sinks. The manager has put some sort of calking there but it doesn't seem to have helped. He also promised to change the carpeting but htat was a month ago and nothing has been done.
