brokers fees

My girlfriend rented an apartment through a broker,
on Thursday last week. She gave them a security deposit and paid the brokers fee.
Yesterday, she called them and explained that she will not be taking
the apartment since she is not going to the original law school she planned
on going to. The broker stated that the lease was not countersigned as of yet.
The broker also indicated that she would get the security deposit back.
The broker then explained that she would not get any of the fee back.
What can she do? How can she get the fee back? By the way, the apartment was
not shown to her by the broker, it was simply an exclusive. She went and saw the
apartment with the doorman and simply signed through the broker.
