: I recently moved to the second floor of an appartment building. The tenet below is a heavy smoker and the smoke rises into my appartment. I am not a smoker and find this very distressing. I asked the landlord if we could move to a different appartment. He said that we could not. Is this right? do we have any legal rights here?

What is lost in this thread is that smokers also have rights -- to smoke
in their own apartments. Those who are sensitive should inquire from
landlords before renting that there are no smokers in adjoining units.
