10% increase for additional occupant

Owners of rent controlled apartments are entitled to a 10% increase for each "additional occupant." What if the "additional occupant" is a caretaker who sleeps over? What ways are there to avoid paying this increase?

This is a case of an elderly woman who lived with her husband. Her husband died and she took in a friend who helps take care of her.

DHCR ruled in owner's favor. PAR is pending.
