You're probably out of luck, but you've also been getting a lot of mixed messages from landlords and their reps without any documentation. I think you should take steps to find out the actual status of your apartment. Sounds like there's a lot of lying and cheating going on; why trust anything these people tell you verbally? I know there's some mechanism for finding this out from DHCR; hopefully someone can fill you in on the procedure.
