You're probably out of luck, but I'd suggest you take steps to find out whether your apartment is rent-regulated or not. You've gotten a lot of mixed messages here, and since there seems to be so much lying and cheating going on, I'm not sure you should trust anything these people are telling you verbally. I know there's some mechanism for obtaining this info about your apartment through DHCR; hopefully someone will be able to outline the procedure.
