Am I in default if I terminate my lease?

Posted by Meg on August 19, 1998 at 15:17:38:

Im in Atlanta Georgia and Im trying to move to a new job in Virginia. I have a 14 month lease. I received 2 free months rent when I moved in as a move-in special. At move-in I signed a paper stating I would pay back those 2 free months if I defaulted on the agreement. The lease agreement states I may break the lease if I am not in default by giving 60 days notice and paying 1 months rent. I have turned in my notice and the office has accepted it. NOW they have notified me that I must pay back the 2 free months since I am in default of my lease. In the lease "default" is defined as not paying my rent or meeting obligations which would result in the landlord terminating the lease.

I am confused as to whether I am in default or if this company needs the $$ since the property is being refinanced.

Any help would be appreciated.
