losing deposit by signing application

Posted by Miles L. Starkey on August 24, 1998 at 16:06:38:

I signed the application to try to get an apartment at a complex in Orlando, Florida.
I paid a $35 app. fee and a $100 holding fee. After being approved and paying
the $200 deposit and $75 bond, my family got hit with two uncurable sicknesses
in Iowa, and I need to move back there to help take care of them. Now the complex
is telling me that I don't get any of this money back. The application reads this way:
'Applicant has paid $35 as a non-refundable application fee and $100 as a holding
fee. Holding fee will be applied towards application security deposit once applicant has
executed lease agreement. In the event applicant's application is denied only the
holding fee will be refunded by mail in accordance with the law. Should the application
be cancelled by applicant al monies will be forfeited.'
This seems to be unclear concerning the deposit and bond. And when you factor in the
reason for my move, I think I should get something back, especially if they can
find another tenant to rent the apartment by the date I was supposed to take
possession.
I would appreciate hearing any advice anyone may have for me. Thanks. Miles
