Question

Posted by Nolly Yagin on September 28, 1998 at 23:57:34:

Hi,
I'm searching around the net for places to possibly get advice on
this landlord-tennant thing. Would you happen to know any sites where
people chat about this stuff, or possibly give advice? By the way,
would you possibly be able to give some advice?
My parents rented out a cottage to a couple about a year ago. Since
January, their payments for rent have been arriving late. A discussion
between the tennants and my parents resulted in an agreement between
them that the tennants will pay an amount weekly including the monthly
rent (This was signed by both parties). My parents accepted the
agreement hoping that would help them out while the tennants get their
finances in order. For a couple of months, the tennants were fairly
good about following the agreement. The past two months, no payments
have come in. An eviction notice was sent via certified mail, the
tennants rejected the letter. A complaint was filed in small claims
court and a hearing revealed that the tennants filed for bankruptcy and
that they also were planning to move. This decision by the tennants was
not disclosed until today, today was the hearing by the way. I really
don't know about this bankruptcy stuff either, but does this mean that
my parents cannot get any money for the back rent? The judge by the
way, gave no concrete judgement, but instead talked about possibly
holding another hearing in late November. Because of this, is there
still a way to get the tennants to vacate the premises in the meantime
while waiting for their bankruptcy hearing (in early November)? What's
this detainer thing I keep hearing about?
Sorry for dumping my problems on you. If you cannot give any advice
on this problem, might you still have any advice on any other web sites,
that might help? Thanks soooo much.
