I do not know the law in Chicago but if your Uncle has the rent with him in the court then that should end the eviction. If there are problems with the apartment such as lack of heat etc, then have your Uncle prepared to prove them at the hearing. However there may be additional charges for the landlord lawyer fee. Call legal aid out there and see what they say.
