upstairs neighbor is a conga drum player...

I live in a building with a neighbor directly upstairs who pulls out his conga drums and plays LOUDLY. The floors are wooden and he has no carpeting at all, though I don't think from an acoustical standpoint that it would make a difference.

What are my rights (how do I find out)? I live in NYC in a rental. The fellow is fairly cooperative (it seems - I've only gone up once so far, but I've only been here a week). But when he plays, the noise level is simply unacceptable.

The super has mentioned it to him and so far, it's been okay. But if it starts up again, what, if anything, can I do about it?
