Not on lease but tenant for 6 years

Posted by Bill on November 18, 1998 at 15:24:27:

Question:

I'm not on my lease in a rent stabilized NYC apt., but was an original tenant when the leaseholder signed in 1991. He has since moved out and left me there on my own for the past three years. The landlord has accepted and cashed at least two of my rent checks. Recently I received a letter saying that the original leaseholder must send the rent checks. Based on my tenure in the apartment and the cashed rent checks, do I have any rights to a lease?
