This is an unlawful charge. Call DHCR 718-739-6400 and request their fact sheet on unlawful fees. Also call CTRC 212-964-7200 and ask for fact sheets pertaining to broker fees paid to the landlord. You can file a rent overcharge for this from DHCR, ask them for the rent overcharge complaint form. If you need advice on recovering the money or reporting the landlord, just email me.

: My landlord also owns a realty agency. The only way I could rent in his building was to go through his agency and pay a substantial broker's fee. When I was looking at the apartment he didn't disclose that he was the owner of both the building and the Agency, both have different names. This was something I figured out after I signed the lease. I'm suspicious because he has one phone number for both businesses and the receptionist doesn't say the name of either business when she answers the phone, she rambles off numbers instead. This seems strange to me.
