Colorado, Denver city and county........Our landlord has served us with a Notice to Vacate. The reason being that we violated the lease by bringing a puppy on the property without prior written consent. We had a dog here previously, and were not required to have written consent, so did not think this would be a problem. I have received legal consultation that has told me that since I have a term lease and not a month to month, that this Notice to Vacate is invalid.
Here's the question....is my lease definately a term lease. The lease states the following :"For the period commencing on the 1st day of Oct. 1998, and monthly thereafter until the last day of Sept. 1999. After which time this agreement is terminated, without further notice. This lease is for 12 months."
I'm worried because it states "monthly thereafter". But, it also states the lease is for 12 months, which to me means it's a term lease.
Please, any help would be appreciated.
