Charging $ for overnight guests in NY

Posted by Susan on April 05, 1999 at 20:40:41:

My landlord says that I have to pay him $20 a night each time someone stays over otherwise he will evict me. There is nothing in the lease regarding this specifically, however he keeps referring to an area entitled "Use". It states that only party's signing the lease may use the apartment. It also says that it is subject to Tenant's rights under the Apt. Sharing Law. I usually have someone stay over once or twice a week. We are now going to small claims since he has not returned my security deposit and he is countersuing me. This is one of his arguments. Does he have a case?
