I am currently taking my LL to small claims because he has refused to return my security deposit citing "damages". Let me preface this by saying that I lived in a 3 bedroom apt in NY w/2 other roommates. In the time that I lived there 2 roommates moved out and 2 more moved in and he simply crossed the old ones of the lease and put the new ones on. He said that I left nail holes in the walls in a bedroom that I occupied. He isn't holding either of the 2 other roommates liable, and the room he is speaking of had 4 people living in it at various times before me and one person after me. At no time in the last four years has he done a once over of the apt or done any repairs (ie painting) If it is one lease for the apt how can he pin this on me and not my other roommates?
