There actually have been legal definitions for many decades, and yes, it must have a window to be any room for 'living' purposes. There are also square footage minimums for room and for bedrooms, it varies depending on when the buidling was built. You'll find some definitions in the Building Code, the HMC and the MDL: the latter two are on Tenant.Net, the former is nowhere online.

However, what the real estate agent or lanlodrd calls something is just a New York state of mind........
