In the case of Lyon v. S.M.J. Mgt. Corp., Index No. 21631-96, a Manhattan State Supreme Court justice has deemed the time limit for a loft tenant to sue for a rent overcharge to be four years from the date of the overcharge, even if the Loft Board hasn't determined if the premises are covered by the Loft Law.
