Is your spouse not living there anymore? Spouses are usually 'tenant-in-common' or such and have the same rights: but I don't know if that is when they both sign the lease, or if it depends on the state you live in, or what. Also: by reading this board, I got the impression that a Rent Stabilized or Controlled not-on-the-lease-spouse might have to prove succession rights. So, really, give just a few more details.
