fumes from exhaust fan

I live behind a residentual building that houses a caterer on the ground floor and their exhaust fan blowes the kitchen smoke out on the ground level and right into my apartment. Shoudn't the fan be on the roof?
I called the EPA but when they went by they were not cooking so not much happened.
What can I do?
