DHCR Rent Deregulation cap for absent roommate

My landlord is attempting to deregulate my apartment. We originally had four people living there
and on the lease. Two people left but only one was removed by the landlord on the lease. Every time
had to renew our lease my roomate and I would cross out the old names and then sign the lease stating
that John Doe no longer lived there. My landlord is petitioning that my aprtment be deregulated and that the absent John Doe's
income be included in the $175,000 cap. How do I fight this?
