Dispute Before Move In

Posted by Rosalie DiPietro on July 29, 1999 at 10:27:43:

My husban and I rented an apartment starting July 1, 1999.

We asked the Realtor to ask the Landlord if we could move on Saturday,June 25 and if yes,
would he charge us. The Realtor spoke to the Landlord and she said that it
was okay to move on 6/25 as long as we gave him the July rent...which I did.

Now, when I just about ready to made out a check for the August 1999 rent, the
Landlord wants me to include the five days between June 25 and July 1.

I, in good faith, said I would split the days and pro-rate it for 2.5 days versus
the five.

He said it was not acceptable. He wants the pro-ration for all five days. I
said no to the five days.

He said he was going to take legal action.

What recourse do I have? Shouldn't he be taking this up with the realtor?
