The apartment is supposed to be left "broom clean" by the previous tenant, and under §27-2013 of the New York City Administrative Code (Housing Maintenace Code), the landlord is supposed to paint every three years.

If the apartment is not clean and/or needs painting, even if it was painted within the last three years (Multiple Dwelling Law §80), the landlord is responsible to do the required work.

I would suggest taking pictures of the apartment as soon as possible, to use in court, if that becomes necessary.
