The apartment is supposed to be left "broom clean" by the previous tenant, and under §27-2013 of the New York City Administrative Code (Housing Maintenace Code), the landlord is supposed to paint every three years.
If the apartment is not clean and/or needs painting, even if it was painted within the last three years (Multiple Dwelling Law §80), the landlord is responsible to do the required work.
I would suggest taking pictures of the apartment as soon as possible, to use in court, if that becomes necessary.
: I leased a vacant apartment in NYC. I've gotten the run around from
: the landlord and his super. Does anyone know the responsibilities of
: the landlord with respect to preparing a vacant apartment, specifically,
: cleaning and painting? A reference to a NY City or State law would be
: greatly appreciated.
