You don't say where you live, but you should not have paid rent, in 1999, for the last month that you lived there, when you had previously paid it back in 1997. It may not be technically correct for the landlord to hold the rent, but the landlord is not limited in damages to the amount of the security deposit. While lost rent could be part of the damages, it seems unlikely that it would take the landlord a month to repair and/or replace whatever was damaged.


: When the apartment was rented 2 years ago we gave 1 & 1/2 month security plus the last month's rent as the landlord did not want us to use our security as the last month's rent. Now we moved out but we paid the last month's rent up front hoping to get the last month's rent that we gave them 2 years ago back with any security. There was damage and they want to take our security (which I am contesting but anyway) They also want to take our last months rent because they say that they couldnt rent the house out for a month while they cleaned and fixed stuff. I can understand the security but is it legal for them to take our last months rent when we were not living there?
