Usually a lease only becomes valid if you take possession of the appartment within a certain number of days from signing. If you never take possession of the apartment the lease is terminated.
This is usually the case here in NY. Some states have a grace period where the renter can back out legally. I'm not sure what the laws are in your area..you might want to try going to tenent.net's main page at http://tenant.net and lookup your state...
How did you pay this deposit? cash check? did you get a receipt? I would consider calling your States attorney general to ask some questions.
