Joann's msg:

Are basement apts. in a private home in Brooklyn legal? How can I find out if it is or
not? If the apt. is being rented illegally can I get in trouble? Can my landlord get in
trouble? If the landlord does get in trouble am I entitled to get my monies back since I
was unknowing living in an illegal basement apt.?

BS reply:

: 1. possibly; 2. go to county clerk's office and look at the certificate of occupancy; 3. no; 4. yes; 5. no.

my response:

BS seems to have quite a few recent messages: enough to use my email address, not enough to write trustworthy answers..

Although other agencies may have photocopies of it (which they may or may not let you read and/or copy), it is the Dept of Buildings that issues the CofO in NYC. It is only at the DoB that one can get a CERTIFIED copy of the CofO, which is what Joann will need in Court.
